1. Acceptance of terms
By downloading, installing, or using Toy Phone, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated into these Terms by reference. If you are using the App on behalf of a child, you confirm that you are their parent or legal guardian and that you accept these Terms on their behalf.
2. Description of the app
Toy Phone is a pretend-play application designed for babies and toddlers (roughly ages 6–36 months). It simulates a phone with pretend calls, a pretend camera, a keypad, drawing, and music, all within a closed, offline sandbox. The App does not connect to the real telephone network, the internet (other than to verify subscription status, as described in our Privacy Policy), or any social platform.
3. Eligibility & parental responsibility
Toy Phone is intended for use by young children under the direct supervision of a parent or guardian, who is responsible for downloading the App, configuring its settings (including Parent Settings, Safety Lock, and Manage Contacts), and supervising its use. As the supervising adult, you are responsible for:
- Deciding whether the App is appropriate for your child and setting it up accordingly.
- Any content you add to the App, such as pretend contact names or photos.
- General supervision of your child’s device use, consistent with your own parenting judgment.
- Any subscription purchase made through the App, which is confirmed through your Apple ID or Google Play account and its own purchase-authorization controls (such as Face ID, Touch ID, or a password) — not by your child.
4. License to use
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use Toy Phone on devices you own or control, for personal, non-commercial, pretend-play purposes. This license does not grant you any ownership rights in the App itself.
5. Acceptable use
You agree not to:
- Copy, modify, reverse-engineer, decompile, or create derivative works of the App, except where applicable law expressly permits it.
- Redistribute, sublicense, rent, lease, or resell the App or access to it.
- Use the App in any way that violates applicable law or infringes the rights of others.
- Attempt to circumvent or interfere with the App’s security, sandboxing, or parental controls in a way intended to cause harm.
6. Your content
Any content you or your child create within the App — pretend-play photos, drawings, or pretend contact names/photos — stays stored locally on your device, as described in our Privacy Policy. You retain all rights to that content. We do not access, collect, or claim any ownership over it, and we have no ability to view, back up, or restore it — if it’s deleted from your device (including by uninstalling the App), it’s gone.
7. No ads. Subscriptions & free use
Toy Phone contains no advertising. It does include an optional subscription, on these terms:
- First 7 days. Starting from install, the App is free, unlimited, and unrestricted for 7 days.
- After the first 7 days, without a subscription. You get 30 minutes of unlimited, unrestricted use every 7 days. Once that 30 minutes is used, all screens except Parent Settings are paywalled until your next 7-day window opens (or until you subscribe).
- With a subscription. A weekly or monthly subscription restores unlimited, unrestricted access to every feature for as long as the subscription remains valid.
Subscriptions are billed and managed through the Apple App Store or Google Play, whichever you used to download the App. Pricing, currency, and billing frequency are shown in the App and in the applicable app store listing before you confirm a purchase. Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before renewal; your payment method will be charged for renewal within that 24-hour period. You can cancel at any time through your Apple ID or Google Play account settings — cancelling stops future renewals but does not refund the current billing period. Refunds are handled by Apple or Google under their own refund policies, not by us directly.
8. App store terms
If you downloaded Toy Phone from the Apple App Store or Google Play, your use of the App is also subject to that store’s applicable terms of service, in addition to these Terms. In the event of a conflict specific to store operations (such as installation, updates, or refunds), the relevant app store’s terms govern that aspect.
9. Intellectual property
The App, including its name, logo, design, artwork, and underlying software, is owned by us or our licensors and is protected by intellectual property laws. Except for the limited license granted in Section 4, no rights are transferred to you.
10. Disclaimer of warranties
The App is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of defects.
11. Limitation of liability
To the fullest extent permitted by applicable law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising out of or related to your use of the App. Our total liability for any claim arising from these Terms or the App will not exceed the amount you paid us for the App in the 3 months before the claim arose (which, if you are using the App during a free period, is zero).
12. Privacy & children
Our Privacy Policy explains how the App handles data (in short: play content never leaves your device, and the only data transmitted is the limited subscription-status information described there) and how it’s designed with children’s privacy laws such as COPPA in mind. By using the App, you also agree to the practices described there.
13. Termination
You may stop using the App at any time by uninstalling it from your device. We may suspend or discontinue the App, or any of its features, at any time, including if you violate these Terms, though given the App’s offline, account-free design, this would typically take the form of no longer distributing updates rather than remotely disabling anything on your device.
14. Changes to these terms
We may update these Terms from time to time to reflect changes to the App or applicable law. We’ll update the “Last updated” date at the top of this page when we do. Continuing to use the App after changes take effect means you accept the revised Terms.
15. Governing law
These Terms are governed by the laws applicable in your place of residence, without regard to conflict-of-law principles, except where applicable consumer protection law provides otherwise.
